1. Acceptance of Terms
By downloading, installing, accessing, or using Velmigo (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or rules referenced herein. If you do not agree to these Terms in their entirety, you must immediately cease all use of the App and delete it from your device. Your continued use of the App constitutes your ongoing acceptance of these Terms as they may be modified from time to time.
2. Description of Service
Velmigo is a ski and snowboard social platform that provides GPS-based run tracking, speed and distance estimation, leaderboards, resort information, in-app messaging, walkie-talkie voice communication, achievement systems, and related features. The App is designed for recreational and entertainment purposes only. Velmigo is not a safety device, emergency communication tool, navigation aid, or substitute for professional instruction, avalanche awareness equipment, or resort safety systems.
3. Eligibility
You must be at least 13 years of age to use Velmigo. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By allowing a minor to use the App, the parent or guardian assumes full responsibility for the minor's use and any consequences thereof.
4. Account Registration
You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not responsible for any loss or damage arising from your failure to protect your account information.
5. Subscriptions & Payments
Access to Velmigo requires a paid subscription. Subscriptions are billed through the Apple App Store or Google Play Store. Prices are displayed in the App before purchase. Promotional QR codes distributed via Velmigo-affiliated merchandise or partnerships may grant complimentary access for a fixed period as specified at the time of redemption. All payments are processed by Apple or Google — we do not store or process payment card details directly.
6. Auto-Renewal & Cancellation
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription through your device's app store settings (Apple: Settings → Apple ID → Subscriptions; Google: Play Store → Subscriptions). No refunds are provided for partial billing periods. Refund requests must be directed to Apple or Google, as applicable.
7. ASSUMPTION OF RISK — SKIING AND SNOWBOARDING
IMPORTANT — PLEASE READ CAREFULLY. You expressly acknowledge and agree that skiing, snowboarding, and all related winter sports activities are INHERENTLY DANGEROUS and carry significant risks of SERIOUS BODILY INJURY, PERMANENT DISABILITY, OR DEATH. These risks include, but are not limited to: • Collisions with other skiers, snowboarders, objects, trees, rocks, lift towers, fences, buildings, or man-made structures. • Falls, jumps, drops, and impacts on groomed runs, ungroomed terrain, moguls, terrain parks, halfpipes, or backcountry areas. • Avalanches, ice falls, rockslides, tree wells, crevasses, and other natural hazards. • Exposure to extreme weather conditions including blizzards, whiteouts, extreme cold, wind, lightning, and rapidly changing conditions. • Equipment failure or malfunction including bindings, boots, helmets, goggles, or other gear. • Chairlift, gondola, or surface lift accidents. • Altitude sickness, hypothermia, frostbite, sunburn, snow blindness, and dehydration. • Encounters with wildlife. • Getting lost or stranded in backcountry, off-piste, or unmarked terrain. • Drowning in creeks, rivers, ponds, or other bodies of water on or near ski terrain. • Injuries caused by the negligence or reckless behavior of other individuals on the mountain. By using Velmigo, you voluntarily assume all risks associated with skiing, snowboarding, and related activities, whether or not described above, including risks that are not currently known or foreseeable.
8. DISTRACTION AND DEVICE USE WARNING
Using any mobile application, including Velmigo, while skiing or snowboarding creates additional dangers. Looking at your phone, interacting with the App, using walkie-talkie features, reading messages, checking statistics, or being otherwise distracted by your device while on the mountain can lead to serious injury or death. You agree that: • You will NOT operate the App while actively skiing, snowboarding, or riding lifts unless it is safe to do so and you are fully stopped. • You are solely responsible for deciding when it is safe to interact with the App. • Velmigo bears no responsibility for accidents, injuries, or damages caused by distracted use of the App. • Speed data, run tracking, and other gamification features are for entertainment only and should NEVER encourage you to ski or ride beyond your ability level. • Leaderboards and competitive features are not invitations to take unsafe risks.
9. GPS DATA ACCURACY DISCLAIMER
Velmigo relies on your device's GPS hardware to estimate speed, distance, elevation, and location. GPS technology is inherently imprecise and subject to significant errors caused by atmospheric conditions, satellite geometry, signal interference, terrain, tree cover, buildings, tunnels, and device hardware limitations. You acknowledge and agree that: • Speed readings may be inaccurate by significant margins and should NEVER be relied upon for any purpose beyond casual entertainment. • Distance, elevation, and route data are estimates only. • Resort detection and location features may be inaccurate. • Velmigo is not a substitute for trail maps, resort signage, avalanche transceivers, or professional navigation tools. • You will not rely on any data provided by the App for safety-critical decisions. • We make no representations or warranties regarding the accuracy, completeness, or reliability of any GPS-derived data.
10. WALKIE-TALKIE AND COMMUNICATION FEATURES
Velmigo provides walkie-talkie voice communication and text messaging features. These features depend on cellular data or Wi-Fi connectivity, which is frequently unavailable, unreliable, or intermittent in mountain environments. You agree that: • Velmigo is NOT a reliable communication tool for emergencies. • You must NOT rely on the App's communication features as your sole means of contacting others on the mountain. • Messages and voice transmissions may be delayed, lost, or fail without notice. • In any emergency, you should contact resort ski patrol, call emergency services (112/911), or use dedicated emergency communication devices. • We are not responsible for any consequences arising from failed, delayed, or missed communications through the App.
11. User Conduct
You agree not to: (a) use the App for any unlawful purpose; (b) harass, threaten, abuse, defame, or harm other users; (c) transmit spam, malware, viruses, or offensive, obscene, or illegal content; (d) attempt to access other users' accounts or personal data; (e) reverse-engineer, decompile, or interfere with the App's operation; (f) use the App in any manner that could damage, disable, or impair the service; (g) impersonate any person or entity; (h) use the App to stalk, track, or monitor another person without their consent; (i) share another user's location data, messages, or personal information without their consent; (j) create multiple accounts to circumvent bans or restrictions.
12. Content & Messaging
You are solely responsible for all content you share through Velmigo, including messages, photos, voice messages, profile information, and any other user-generated content. By posting content, you grant Velmigo a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App's features. We reserve the right to remove content that violates these Terms without notice. We do not pre-screen user content and are not responsible for content posted by users.
13. Intellectual Property
All content, branding, trademarks, logos, designs, code, and technology comprising Velmigo are owned by or licensed to Velmigo and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the App or its content without our prior written consent.
14. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Velmigo AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (B) GPS DATA, SPEED MEASUREMENTS, DISTANCE CALCULATIONS, ELEVATION DATA, OR ANY OTHER STATISTICS WILL BE ACCURATE OR RELIABLE; (C) THE APP WILL FUNCTION CORRECTLY IN ALL ENVIRONMENTS, INCLUDING MOUNTAIN, COLD-WEATHER, OR LOW-CONNECTIVITY CONDITIONS; (D) ANY DEFECTS WILL BE CORRECTED; (E) THE APP IS SUITABLE FOR ANY PARTICULAR PURPOSE INCLUDING SAFETY, NAVIGATION, OR EMERGENCY USE.
15. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Velmigo, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY: • PERSONAL INJURY, BODILY HARM, DEATH, OR PHYSICAL DAMAGE OF ANY KIND. • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. • LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES. • DAMAGES ARISING FROM: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY USER OR THIRD PARTY; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA; (D) RELIANCE ON GPS DATA, SPEED, DISTANCE, OR ANY STATISTICS PROVIDED BY THE APP; (E) ACCIDENTS, INJURIES, OR INCIDENTS OCCURRING WHILE SKIING, SNOWBOARDING, OR ENGAGING IN ANY ACTIVITY WHILE USING THE APP; (F) FAILURE OR DELAY OF COMMUNICATION FEATURES; (G) ANY INTERACTION WITH OTHER USERS FACILITATED BY THE APP. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR PERSONAL INJURY OR DEATH CAUSED BY NEGLIGENCE, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO Velmigo IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY EUROS (€50), WHICHEVER IS GREATER.
16. RELEASE AND WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Velmigo, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES FROM AND AGAINST ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION WHATSOEVER, ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, INJURY, OR DEATH THAT MAY BE SUSTAINED BY YOU, WHETHER CAUSED BY THE NEGLIGENCE OF Velmigo OR OTHERWISE, WHILE USING THE APP OR PARTICIPATING IN ANY ACTIVITY RELATED TO OR FACILITATED BY THE APP. YOU ACKNOWLEDGE THAT THIS RELEASE COVERS UNKNOWN AND UNFORESEEN CLAIMS, AND YOU EXPRESSLY WAIVE ANY RIGHTS UNDER LAWS THAT WOULD OTHERWISE LIMIT THE SCOPE OF THIS RELEASE TO KNOWN CLAIMS.
17. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Velmigo, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of another person or entity; (d) any content you submit through the App; (e) any injury or damage to any person or property arising from your activities while using the App.
18. Termination
We may suspend or terminate your account at any time, with or without cause, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, or is otherwise objectionable. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately. Sections 7-17 shall survive any termination of these Terms.
19. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be resolved exclusively in the courts of Budapest, Hungary, except where prohibited by local consumer protection laws. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
21. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Velmigo regarding your use of the App, and supersede all prior agreements, understandings, and communications, whether written or oral.
22. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.
